The applicant suffered multiple injuries in 1998 and 1999 which resulted in failed back syndrome. Unfortunately with the current laws, multiple injuries to the same body part can greatly limit the disability when the permanent disability is split over three dates of injury. In this case however, we were able to fight the “Benson” apportionment and negotiate a great recovery for the applicant. The case was finally settled in 2019 for a structured payout of over $1,000,000 with a present cash value of $825,000.
