Injured Worker v. Corcoran State Prison, SIBTF

Practice Area: SIBTFWorkers Compensation
Date: July 18th, 2025
Outcome: SIBTF award for 100% disability (Estimated value in excess of $450,000)

The injured worker suffered cumulative trauma injury to his bilateral knee, cervical spine and bilateral arm from 08/05/2018 to 08/27/2019 while working as a lieutenant at Corcoran State. These injuries led to a settlement by stipulations at 56% permanent disability with medical care open.

After the resolution of his workers compensation, Silberman & Lam, LLP applied for subsequent injury benefits trust fund (SIBTF) on 09/29/2023 because the injured worker had preexisting conditions including asthma, hypertension, allergic rhinitis and sinusitis, prediabetes, erectile dysfunction, problems on his lumbar spine, right cubital tunnel syndrome and right shoulder.

Subsequently, Silberman & Lam, LLP obtained a 100% disability award from SIBTF on behalf of the applicant. As a result, the applicant became eligible for retroactive benefits amounting to $1,612 and ongoing weekly payments of $383 (after offset for disability retirement), subject to annual increases and cost-of-living adjustments (COLA) for life. Based on average life expectancy, the present value of the award is estimated at $450,000.
