Injured Worker v. Hoa Binh Supermarket

Practice Area: SIBTFWorkers Compensation
Date: May 28th, 2025
Outcome: SIBTF award for 100% disability (Estimated value in excess of $500,000)

The injured worker sustained a work-related cervical spine injury with bilateral radiculopathy, which also impacted her lumbar spine and both wrists, while employed as a grocery stocker at Hoa Binh Garden Grove supermarket. She subsequently filed a workers’ compensation claim, which was resolved through a compromise and release settlement in the amount of $90,000.

Once her workers’ compensation claim was resolved, Silberman & Lam, LLP applied for subsequent injury benefits trust fund (SIBTF) on her behalf, as she had preexisting health issues such as hypertension, diabetes, GERD, headaches, sinusitis, eye problems, and pain in her right shoulder.

After years of hard work, Silberman & Lam, LLP secured a 100% disability award for the injured worker. This entitles the individual to lifetime benefits, which include retroactive payments totaling $4,845.11 and continuing weekly payments of $334.39, subject to annual cost-of-living increases. Based on average life expectancy, the present value of the award is estimated at $500,000.
