Injured Worker v. Precision Castparts Corp.

The injured worker, employed as a machinist at Precision Castparts, suffered multiple work-related injuries over the course of several years. On March 2, 2011, the worker sustained damage to the lumbar spine resulting in left foot drop. This was followed by injuries to the cervical spine and right shoulder on 03/21/2011. Years later, on December 18, 2015, the worker experienced another injury affecting the left shoulder. Ultimately, all claims related to these injuries were resolved through a compromise and release agreement, with a settlement totaling $200,000 reached on August 25, 2022.

After resolving the workers’ compensation case, Silberman & Lam, LLP proceeded to file a claim on behalf of the injured worker with the Subsequent Injury Benefits Trust Fund (SIBTF). This claim was pursued due to the worker’s preexisting medical conditions, which included atrial fibrillation, myocardial bridging, hypertension, kidney disease, gastritis, and anal fissuring.

Through time and consistent effort, Silberman & Lam, LLP secured a 100% disability award from the Subsequent Injury Benefits Trust Fund (SIBTF) for the injured worker. As a result of this successful claim, the worker became eligible for lifetime benefits under SIBTF. The award entitles the worker to receive retroactive benefits totaling $385,871.40. In addition to the retroactive payment, he will receive weekly payments of $1365.03, which is subject to annual increases based on cost-of-living adjustments. Based on average life expectancy, the award has an estimated present value of $1,000,000.
