Injured Worker v. State of California, Dept of Probation/SIBTF

The injured worker suffered a cumulative trauma injury from 9/15/1995-4/23/2007 while working for the State of California  which settled by stipulations to 76% on October 14, 2013.  After settlement of the workers compensation claim, an SIBTF claim was filed by Silberman & Lam, LLP.  The applicant had a prior work injury that rated at 34%.   After 10 years of litigation, an agreement was finally reached with SIBTF for an award of 100% disability.  The applicant was entitled to back benefits of $290,047.84 and ongoing benefits of $1446.81 per week increasing each year with a COLA for life with offsets for a disability pension and permanent disability.
