Injured Worker v. Interstate Distributor Co.

In this case the applicant truck driver sustained orthopedic injuries after the vehicle suffered hard breaking. The defense disputed the injury based on the electronics in the vehicle that did not register a hard breaking incident. The applicant made a credible witness and the trial judge found for the applicant. The defense appealed the case to the Workers Compensation Appeals Board reconsideration unit, then to the California Court of Appeals and lastly to the California Supreme Court. After over 18 months of appeals, all of the courts found for the applicant and against the various devices in the vehicle which found there was no hard break recorded.
