This case involved a failed back surgery and over 17 years of fighting with CIGA over medical treatment. The case was resolved for $2.75 Million by way of a compromise and release agreement.
It was a complicated case that involved an out of state injured worker and a number of fights in order for CIGA to approve brand name medication as the applicant was intolerant to many generic medications.
While the defense was reluctant to settle for many years as CIGA often takes the stance of keeping future medical care open, through a series of informal conferences, Mr. Silberman was able to convince them that settlement was in their best interest.
