The injured worker suffered a work-related injury with cumulative trauma from 12/30/1990 to 11/08/2016 while working as a front desk receptionist at Senior Resource Group, which affected his expressive aphasia, memory and concentration, gait, digital dexterity, hypertension, and psych. This was settled by compromise and release for $240,000 on 09/16/2021.
Following the settlement of his workers’ compensation case, Silberman & Lam, LLP filed for subsequent injury benefits trust fund benefits (SIBTF) as the injured worker had preexisting health conditions including diabetes, anemia, reflux disease, bronchitis, severe obesity, migraine headaches, and fatty liver.
Later, Silberman & Lam, LLP successfully secured an award of 100% disability against SIBTF. As a result, the injured worker was entitled to back benefits amounting to $73,243.65 and ongoing weekly benefits of $302.71 increasing each year plus cost-of-living adjustments (COLA). The award has an estimated present value of $500,000, based on the average life expectancy.
