Injured Worker v. Amazon, SIBTF

The injured worker suffered an industrial injury with cumulative trauma ending on 09/06/2022 that affected her cervical spine, bilateral shoulder, lumbar spine and bilateral plantar fasciitis while working as a warehouse clerk at Amazon. This was settled by compromise and released for $125,000 on 10/24/2023.

Following her workers compensation claim settlement, Silberman & Lam, LLP filed for subsequent injury benefits trust fund (SIBTF) due to the injured worker’s preexisting health conditions including paroxysmal disorder, shingles, hypertension, sleep, obesity, prediabetes, dermatitis, left ankle, right ankle, allergic rhinitis, TMJ, and hysterectomy.

Later, Silberman & Lam, LLP successfully obtained an award of 100% disability for the injured worker, he then was entitled to back benefits amounting to $13,295.91 and ongoing weekly benefits of 174.92 increasing each year with COLA. Based on the average life expectancy, this award has an estimated present value of $200,000.
