The injured worker suffered a cumulative trauma injury from 10/1/2008-12/2/2015 and a specific injury on 10/14/2015, which was settled by Compromise and Release for $225,000 on March 7, 2019, due to his employment with Anaheim Ice Management. After settlement of the workers’ compensation claim, a SIBTF claim was filed by Silberman & Lam, LLP. The applicant pre-existing injuries to his left hip, neck, right shoulder, hypertension, headaches, rhinitis, asthma, eczema, and had gastri0 intestinal issues. Based on the arguments made in favor of the applicant and the reporting obtained by the doctors, the applicant was able to obtain an award for 100% permanent disability from SIBTF. The applicant was entitled to back benefits of $78,732.70 and ongoing benefits of $768.89 per week, increasing each year with a COLA for life less some offsets for the workers’ compensation permanent disability and social security disability.
