The injured worker developed hypertension and suffered a stroke when she sustained industrial cumulative trauma injury from 07/18/2004 and 05/19/2019, during her employment as a nurse. This was settled through compromise and released for $400,000 on 04/27/2022.
After her workers’ compensation case was resolved, Silberman & Lam, LLP filed for subsequent injury benefits trust fund (SIBTF) due to the injured worker’s preexisting health conditions including insomnia, chronic headache, prediabetes and issues with her right ankle.
On 03/14/2025, Silberman & Lam, LLP was able to obtain the award of 100% disability against SIBTF. As a result, the injured worker was entitled to lifetime benefits. She received back benefits of $127,250.15 and ongoing weekly benefits amounting to $820. Based on the average life expectancy, the award has an estimated present value of $1,400,000.
