The injured worker suffered an industrial injury on 10/31/13 to her right shoulder, lumbar spine and left knee which settled by Compromise and Release for $290,000 on April 8, 2020 due to her employment with Lotus Home Health Care. After settlement of the workers compensation claim, an SIBTF claim was filed by Silberman & Lam, LLP. The applicant had pre-existing injury to her right knee, asthma, tachycardia, sleep problems, chronic reflux disease, headaches, sinusitis, and thyroid disease. Silberman & Lam was able to negotiate settlement at 100% disability. The applicant was entitled to back benefits of $173,044.88 and ongoing benefits of $1046.84 per week increasing each year with a COLA for life.
